SDGI Newsletter • November 2024 went out to members, friends and subscribers on 31st October 2024

This month is filled with exciting events for our directors. We’re thrilled to launch the Exploring Reality programme with its first module. Our emerging documentary directors will gather in Cork for an immersive week of masterclasses, led by renowned filmmakers, including Charlotte Munch Bengtsen (All That Breathes & Mistress Dispeller), Louise Osmond (The Reckoning Silence & Dark Horse), Lea Glob (Apolonia, Apolonia), Pat Collins (Henry Glassie: Field Work), and Amie Williams (An Unfinished Journey Uncommon Ground).

Following that, on Wednesday, 6th November, we’ll host our Directors in Dialogue, Work in Progress meet-up. This is a great opportunity to share your current projects or discuss your experiences as a director.

Then, on Friday, 8th November, join us at Dublin Castle’s Printworks for an event with Publishers Ireland. They will present a selection of books available for option, followed by a drinks reception, a great chance to relax and listen to potential film/TV adaptation ideas.

The Exploring Reality programme’s second module will bring our directors back to Cork on 25th November for further residency training.

This week, SDGI met with the Revenue Department to discuss the Employment Status Guidelines for Determining Employment or Self-Employment Status of Individuals. While these guidelines suggest that directors in the film and television industry may often be classified as employees of production companies, Revenue clarified that there is no requirement for all directors to be employees; the classification is determined on a case-by-case basis under the framework. A helpful reminder for directors: according to page 30 of the guidelines, “Where a worker produces content of his or her own volition and offers that content for sale to various media outlets, their status will, subject to the framework, generally be that of an independent provider subject to self-assessment as a self-employed worker. Commissioned work, i.e., where a media outlet engages a person to produce content, will, subject to the framework, generally result in the person being an employee of the media outlet in respect of the work.”

Revenue has made it clear that they cannot enter a collective agreement on guideline interpretation with SDGI and that each case must be assessed individually. However, they indicated that if a director meets the framework for self-employment, Revenue has no objection to that classification. If you encounter any issues with the guidelines, please don’t hesitate to reach out to the Guild. We will also send more information to members regarding employment classification for directors.

On the topic of copyright, Ireland’s Statutory Instrument 567 of 2021. SDGI will meet with producers and other stakeholders later this month to continue our ongoing discussions on implementing these guidelines and copyright issues in directors’ contracts. Our goal is to establish clear and practical guidelines for applying this legislation.

Please feel free to contact the Guild with any questions or concerns about your employment status or copyright protections. We hope to see you at one of our events this month!

Thank you for your continued support of the Directors Guild.

Warm Regards,

Birch
